How to respond to an inspection, sanction or cancellation of VUT
The moment a tourism inspection record, an initiation decision or a cancellation notice arrives is the most decisive of the entire procedure. The actions taken in the following hours determine the success of the defence. This is a step-by-step guide.
Step 1 — Identify the document
- Inspection record.
- Initiation decision of sanctioning procedure.
- Notice of opening of cancellation procedure.
- Precautionary measure (suspension, sealing).
Step 2 — Compute the deadline
- Allegations to the initiation decision: 10 days.
- Hierarchical appeal: 1 month.
- Reconsideration appeal: 1 month.
- Contentious-administrative appeal: 2 months.
Step 3 — Gather evidence
- Tourism Registry inscription certificate.
- Responsible declaration receipt.
- Operating-period communication receipt.
- Documentation of equipment (invoices, photographs).
- Contracts with guests and proofs of registration in SES.
Step 4 — Draft the allegations
Address each fact one by one. Distinguish facts from legal classification. Invoke proportionality, motivation and applicable rules. Propose witness and expert evidence if relevant.
Step 5 — Check lapsing and prescription
The first line of defence. If the procedure has lapsed or the infringement has prescribed, the file falls.
Step 6 — Plan the remedies in advance
From the first allegation, foresee the route in case of adverse decision.
