Cancellation of tourist licence in Fuengirola for independent access: the dynamics

The Fuengirola Town Hall is activating cancellation procedures of VUT licences based on the «independent access» argument, similarly to the Málaga instruction. The defence has solid grounds.

Defence grounds

• Lack of formal modification of the general urban plan.
• Disproportion of the restriction.
• Lapsing of the procedure if not resolved within 6 months.
• Application of the TSJA Granada doctrine (no restriction by interpretation).

1. Identify the procedure (administrative initiation or cancellation).
2. Compute deadlines.
3. File allegations within 10 days from initiation.
4. Request precautionary suspension if necessary.
5. Plan the contentious-administrative route.
